MINUTES OF THE BOARD OF DIRECTORS’ MEETING
January 20, 2002
(Subject to approval and correction at the Board of Directors’ Meeting
on February 17, 2002)

CALL TO ORDER: by President Bob Bowman at 9:30 a.m.
PRESENT: Lucy Bain, Ola Bergsholm, Bob Bowman, Laura Mork, Barbara Myers, Treasurer LuWilla Croy, Operations Manager John Graham and Business Manager Jackie Granger.
EXCUSED: Darlene Stoffer.
VOTING STATUS: All board members present are in good standing.

MINUTES OF PREVIOUS MEETING:

(2002/1/1) M. Barbara Myers 2nd Laura Mork  “approve the minutes of the last meeting.” Passed. (Referring to the minutes of the December 9, 2001 meeting.)
MEMBERS & GUESTS:
Ross Moore - observing and status of his property; Al Depencier - status of property, Larry Hagan - regarding letter received informing of recreational vehicles not being allowed in LISECC, Celine Belanger- recreational property and letter received, Dale Depencier - same reason, Chuck Ortego - new resident and observing, Don Adema - observing, Jack Mulhern - adjoining of lots and current bylaws and appreciates the letter sent out regarding cleanup of Scenic Estates, Norma Bohl - read letter (see correspondence) and a number of people used the shuttle and appreciated it.
 

COMMUNICATIONS:
Norma Bohl – objected to lack of follow through regarding letter she read in October meeting, it was posted on the website and posted outside the clubhouse and sent to subscribing members but was not sent out with newsletter as promised, low water pressure at her house, and assurance of repairs to Mt. Vista Place being taken care of by contractors.

Jamil Brownson - Relating financial situation and request to extend period to arrange a payment schedule to payoff outstanding balance and forestall lien foreclosure proceeding. (See Finance.)

Mike and Cheryl Jenkins - Informing of new address and requesting the payment agreement be sent or emailed so that it can be signed and returned and promise of $300 upon receiving the agreement. (See Finance.)

Kim Demers - telephone conversation: was informed by Whatcom County that the current use of his property was in violation of Whatcom County Code, Kim was unhappy with the current situation and the property does not perc.
 

PROPERTY COMPLIANCE - The land manager of Whatcom County was met with in December to clarify rules which apply to Scenic Estates. The applicable Whatcom County Code is now available from the LISECC Business Office (360-758-2699). This is a county issue and not anything to do with Scenic Estates bylaws. At some point there was information which was inaccurate given to our members regarding the use of recreational vehicles in LISECC. The county has appointed a compliance officer to Lummi Island and Scenic Estates and the enforcement or notification of non-complying properties will come from them. The letter sent out to some members regarding recreational vehicle use in LISECC was trying to inform all property owners that may be affected. Whether or not the individual properties will be cited is up to the county. Discussion followed. 

Barbara Myers submitted her written report:

The committee as a whole has not met during the end of the year. However, at the request of a member at our last Board meeting the Board President Bob Bowman, The Compliance Chairman Barbara A. Myers and The Business Manager Jackie Granger met with the Whatcom County Land Use Manager in addition to the Enforcement Officer, to clarify the regulations and codes that are used to govern Scenic Estates. Partly as a result of that meeting, and to be sure all members are aware of these rules, we have sent letters to all trailer owners advising them of the county restrictions on land use in Scenic Estates and on Lummi Island as a whole.  We also learned that the county has assigned a county Enforcement Officer to review our area on a regular basis due to the many violations in the area. As stated previously it is our hope people will make an effort to follow the codes and regulations of Whatcom County and the applicable Scenic Estates By-Laws. If you have any questions on this we can make a copy of the county codes available to you by calling our Business Office.  There has been in the past some errors made by previous boards and members in these matters, either through misunderstandings or misinformation. We do wish to work with people to the best of our ability to correct these errors. We are looking forward to a great 2002 and wish all our members the best in this New Year.


Report on Executive Session:

At the last Board meeting it was announced that there would be an executive session to discuss personnel, the meeting did not take place. This meeting will occur directly after today’s Board meeting
 
 

COMMITTEE REPORTS:
PLANNING/WATER:

John Graham submitted a written report, as follows: 

WATER  Total gallons used for the month of December was 576,200 gallons. Average daily usage in the month was 19,200 gallons per day. Average usage for December 2000 was 26,900 gallons per day, but in December of last year we drained both storage tanks and repaired valves. Usage for the month is normally 18,300.
Lee O’Dell the consultant from EES consultants spent two days reviewing our water treatment processes, and submitted a written report. We will be reviewing that report in the next several months. The bottom line was the Mr. O’Dell was very impressed with the quality of our operation, but indicated that the seasonal taste problems will not “go away”.
We had several power outages in December which always require that the treatment plant system be reset.
RESERVOIR The reservoir is at overflow and heavy rains did cause minor washouts at the pump back system..
TESTING  Water samples have been submitted to Avocet and results have been returned as satisfactory. We were required to conduct an Inorganic Chemical analysis for the year 2001, primarily for nitrates and results have been sent to DOH. The results as usual were excellent.
WATER LEAKS  We had two water leaks in December, one on Dogwood Terrace, a service problem, and the other in the main at the clubhouse, which took several days to repair.
John Graham stated EES Consultants was brought out to look at our water treatment plant and they stated that it is currently running at 99% of its capacity. The system was designed in 1970. This does not mean that there is anything wrong with the system. There were some items that may need attention. The top issue was that the media bed in the filter tank requires changing with an approximate cost of $3,200. Other recommendations are being reviewed at this time. Laura Mork stated that the consultant did a thorough review and the water and operations committees will review the report and a plan will be put together based on that report.

Bob Bowman asked about clarification on the taste issue. John Graham stated that when the pump is turned on in the morning there is a turbidity spike. This is a surface water system - the taste is inherent in the system. Laura Mork asked if this happened when the water temperature changes and that this is a problem we will continue to have. In the report we will be looking at ways to fine tune the system. Bob Bowman stated that he spoke with Dave Wertz and it was suggested that a chlorine injection system be introduced at the fire hall but there is a taste complaint regarding chlorine in the water. Laura Mork stated that surface water systems will always have a taste issue. There may be things we can do which will be focused on when reading this report to make the taste less extreme. Discussion followed. 

Ola Bergsholm asked if there was a pressure valve that could be adjusted that may be affecting Norma Bohl’s water pressure. John Graham stated there was a pressure reducing valve at Hales Passage and Mt. Vista. It might be a good idea to have a second pressure valve installed there. John Graham will be checking the pressure on Mt. Vista. Laura Mork asked Norma Bohl if she was aware of any others who have noticed this problem. Norma stated that Fred Dryden mentioned it at the last meeting. Laura Mork asked if a pressure test profile be done on Mt. Vista. John Graham will take care of that. Bob Bowman stated that a report will be presented at the next meeting.
 
 

OPERATIONS:

Darlene Stoffer submitted a written report.

John and I continue to meet regularly and keep in touch by phone in between times. 
The electrical work on the Clubhouse should be scheduled this month....a new "panel" will have to be purchased, as the old part to be replaced cannot be found..too old! John will have to coordinate the Electrician's arrival with that of Puget Sound's, as they must be here at the same time....that should prove interesting! 
John also provided me with a copy of the EES Consulting Review....interesting. The Board might want to read and discuss it....according to the Consultant, we might have to get used to a funny taste in our water at certain times of the year...has to do with 'temperature' of the reservoir. 
Grounds’ keeping is progressing quite well. The Clubhouse and surrounding areas are beginning to take on their former lovely appearance....Nice work, John and Kevin! 
The Clubhouse floor is scheduled to be stripped and rewaxed by the end of January. 
General upkeep and repairs, if needed, to be done at that time.


John Graham submitted a written report.

MAINTENANCE: We have been cleaning and clearing at the entrance to the Clubhouse area. The brush has been allowed to get ahead of us in the last ten years and we will be continuing to work on cleanup.
MISCELLANEOUS: We had several days of strong winds and combined with high tides we had four boats that were washed out into the bay. Several boats that were tied to logs appeared to be damaged. The only boats that are now on the beach are those that residents indicated they will be using during the winter months. I took photos of the boats during the strong wind and high tide and even the boats that are on the logs were floating and being hammered by floating logs.
John Graham stated that there are two associations which might be beneficial to join. They are: The American Water Works Association and Evergreen Rural Water of Washington. Laura Mork stated that it would be beneficial to join an association these might be reviewed to see which is the better one.

John Graham stated that a report was prepared regarding road sweepers. John Graham stated that Ola felt a sweeper might be retrofitted to the backhoe but this is an extra duty for an already taxed piece of equipment. A walk behind sweeper would cost $2,500. Bob Bowman asked if a mechanical sweeper would take care of the needles and moss. John Graham stated that this would have to be tested prior to any purchase. Discussion followed. More research will be done by John Graham including Municipal Auctions.

John Graham stated that the clubhouse area is being cleaned of debris and brush. This hasn’t been done in ten to fifteen years and the clubhouse area is almost complete. Bob Bowman commended operations for their work in this area as communicated by Darlene Stoffer.
